1) Scope of Application
1.1 These General Terms and Conditions (hereinafter “GTC”) of Femboyzone, operating under the name “Femboyzone” (hereinafter “Seller”), apply to all contracts for the delivery of goods concluded between a consumer or entrepreneur (hereinafter “Customer”) and the Seller regarding the goods displayed in the Seller’s online shop. The inclusion of the Customer’s own conditions is hereby rejected unless otherwise agreed.
1.2 These GTC apply accordingly to contracts for the delivery of vouchers unless otherwise regulated.

1.4 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that predominantly are neither commercial nor self-employed professional activity.
1.5 An entrepreneur within the meaning of these GTC is a natural or legal person or a legally capable partnership who acts in the exercise of their commercial or self-employed professional activity when concluding a legal transaction.
2) Conclusion of Contract
2.1 The product descriptions contained in the Seller’s online shop do not constitute binding offers by the Seller but serve for the Customer to submit a binding offer.
2.2 The Customer can submit the offer via the online order form integrated into the Seller’s online shop. By placing the selected goods in the virtual shopping cart and completing the electronic ordering process, the Customer submits a legally binding contractual offer by clicking the button that completes the order process regarding the goods contained in the shopping cart.
2.3 The Seller can accept the Customer’s offer within five days

by sending the Customer a written order confirmation or an order confirmation in text form (fax or e-mail), whereby receipt of the order confirmation by the Customer is decisive, or

by delivering the ordered goods to the Customer, whereby receipt of the goods by the Customer is decisive, or
-
by requesting payment from the Customer after the order has been placed.
If several of these alternatives occur, the contract is concluded at the time the first of these alternatives occurs. The acceptance period begins the day after the Customer sends the offer and ends at the end of the fifth day following the sending. If the Seller does not accept the Customer’s offer within this period, this shall be deemed a rejection of the offer, and the Customer is no longer bound by their declaration of intent.
2.4 If the Customer selects a payment method offered via PayPal, payment is processed by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter “PayPal”), under the PayPal terms of use, which can be viewed at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full or, if the Customer does not have a PayPal account, under the terms for payments without a PayPal account at https://www.paypal.com/de/webapps/mpp/ua/privacywax-full. If the Customer selects a PayPal payment option during the online ordering process, the Seller hereby accepts the Customer’s offer at the time the Customer clicks the button that completes the order process.
2.5 If the Customer selects “Amazon Payments” as the payment method, payment is processed by Amazon Payments Europe s.c.a., 38 avenue John F. Kennedy, L-1855 Luxembourg (hereinafter “Amazon”), under the Amazon Payments Europe terms of use, which can be viewed at https://payments.amazon.de/help/201751590. By clicking the button that completes the order, the Customer simultaneously issues a payment order to Amazon. The Seller hereby accepts the Customer’s offer at the time the Customer triggers the payment process by clicking the button.
2.6 When submitting an offer via the Seller’s online order form, the contract text will be stored by the Seller after conclusion of the contract and sent to the Customer in text form (e.g., email, fax, or letter) after submission of the order. No further access to the contract text will be provided by the Seller. If the Customer has created a user account in the Seller’s online shop before submitting the order, the order data will be archived on the Seller’s website and can be accessed free of charge by the Customer via their password-protected user account with the corresponding login data.
2.7 Before submitting the order via the online order form, the Customer can detect input errors by carefully reading the information displayed on the screen. A useful technical means for better error detection can be the zoom function of the browser, which enlarges the screen display. The Customer can correct their inputs as long as they have not clicked the button that completes the order process.
2.8 Different languages are available for concluding the contract. The specific language options are displayed in the online shop.
2.9 Order processing and contact usually take place via email and automated order processing. The Customer must ensure that the email address provided for order processing is correct and that emails sent by the Seller can be received at this address. Especially when using spam filters, the Customer must ensure that emails from the Seller or third parties commissioned by the Seller for order processing are delivered.
3) Right of Withdrawal
3.1 Consumers generally have a right of withdrawal.
3.2 Detailed information on the right of withdrawal can be found in the Seller’s withdrawal instructions.
3.3 The right of withdrawal does not apply to consumers who, at the time of contract conclusion, do not belong to any member state of the European Union and whose sole residence and delivery address at the time of contract conclusion lie outside the European Union.
4) Prices and Payment Terms
4.1 Unless otherwise stated in the Seller’s product description, the stated prices are total prices including statutory VAT. Any additional delivery and shipping costs will be indicated separately in the respective product description.
4.2 For deliveries to countries outside the European Union, additional costs may arise in individual cases, which are not the responsibility of the Seller and must be borne by the Customer. These include, for example, costs for money transfers by credit institutions (e.g., transfer fees, currency conversion fees) or import duties or taxes (e.g., customs duties). Such costs may also arise in connection with money transfers if the delivery is not made to a country outside the EU but the Customer makes the payment from a country outside the EU.
4.3 The payment method(s) will be communicated to the Customer in the Seller’s online shop.
4.4 If prepayment by bank transfer is agreed, payment is due immediately after conclusion of the contract unless the parties have agreed on a later due date.
4.5 If the payment method offered via PayPal is selected, payment is processed via PayPal, which may also use third-party payment service providers. If the Seller offers payment methods via PayPal where the Seller advances payment to the Customer (e.g., invoice or installment purchase), the Seller assigns the payment claim to PayPal or the PayPal-appointed payment service provider named specifically to the Customer. Prior to accepting the Seller’s assignment declaration, PayPal or its appointed provider performs a credit check using the transmitted Customer data. The Seller reserves the right to refuse the payment method in case of a negative result. If accepted, the Customer must pay the invoice amount within the agreed payment period or intervals and may only pay PayPal or the appointed provider with discharge of debt. The Seller remains responsible for general Customer inquiries (e.g., goods, delivery time, shipment, returns, complaints, withdrawal statements or submissions, or credit notes).
4.6 If the payment method “SOFORT” is selected, payment is processed by SOFORT GmbH, Theresienhöhe 12, 80339 Munich (“SOFORT”). To pay via SOFORT, the Customer must have an online banking account enabled for SOFORT, identify themselves during the payment process, and confirm the payment order. The transaction is executed immediately and the Customer’s bank account debited. More information can be found at https://www.klarna.com/sofort/.
4.7 If payment via Shopify Payments is selected, payment is processed by Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland (“Stripe”). Payment methods offered via Shopify Payments will be communicated in the Seller’s online shop. Stripe may use further payment services with their own terms, which the Customer will be informed of separately. More info at https://www.shopify.com/legal/terms-payments-de.
4.8 If a Ratepay payment method offered by the Seller is selected (e.g., Ratepay invoice, prepayment, direct debit, installment), payment is processed by Ratepay GmbH, Franklinstraße 28-29, 10587 Berlin (“Ratepay”), to whom the Seller assigns its claim against the Customer. The Seller informs about the offered Ratepay payment methods on their website. The Customer can only pay Ratepay with discharge of debt. The Seller remains responsible for general inquiries. Ratepay’s general payment terms apply and can be found at https://www.ratepay.com/legal-payment-terms/.
4.9 When paying by credit card, the invoice amount is due immediately upon contract conclusion. Payment processing is done with PAYONE GmbH, Lyoner Str. 9, 60528 Frankfurt/Main, authorized by the Seller to collect payments. PAYONE debits the Customer’s credit card account immediately after order submission. The Seller remains responsible for general inquiries.
4.9 Payment by Credit Card via PAYONE GmbH

When choosing credit card payment, the invoice amount is immediately due upon contract conclusion.

PAYONE collects the amount from the customer’s credit card.

The credit card is charged immediately after order submission.

4.10 Payment by Credit Card via secupay AG

Same immediate payment due at contract conclusion.

Payment processed by secupay AG (Pulsnitz), to which the seller assigns the payment claim.

secupay collects the amount from the credit card; payment can only be made to secupay with discharge effect.

Credit card charged immediately after order submission.

The seller remains responsible for customer inquiries (returns, complaints, cancellations, credits).
4.11 Payment by Credit Card via Stripe

Payment is due immediately upon contract conclusion.

Payment is handled by Stripe Payments Europe Ltd. (Dublin, Ireland).

Stripe may perform a credit check and can reject the payment method if the check is negative.
4.12 Payment by Riverty Installment

Payment is handled by Riverty GmbH (Verl, Germany), to whom the seller assigns the payment claim.

Riverty conducts a credit check before accepting the assignment.

The seller may refuse Riverty installment payment if the credit check fails.

If approved, the customer pays Riverty under conditions provided in the seller’s online shop.

Payment can only be made to Riverty with discharge effect.

The seller remains responsible for general customer service (goods, delivery, returns, complaints, cancellations, credits).

4.13 Payment via Klarna

Payment processed by Klarna Bank AB (Stockholm, Sweden).

5) Delivery and Shipping Conditions
5.1 Delivery is made to the customer’s specified delivery address within the seller’s delivery area, unless otherwise agreed.
5.2 If delivery fails due to reasons attributable to the customer, the customer bears the reasonable costs incurred, except when exercising the right of withdrawal.
5.3 Risk passes to the customer:

For businesses: upon handover to the carrier or freight company.

For consumers: generally upon receipt by the customer or authorized recipient.

Exception: For consumers, risk passes earlier if the customer appointed the carrier without prior notification from the seller.
5.4 Seller reserves the right to withdraw from the contract if the goods cannot be properly supplied due to issues with their suppliers (not caused by the seller). The customer will be informed and refunded immediately.
5.5 Self-pickup is not possible for logistical reasons.
5.6 Vouchers are sent to customers by email.
5.7 Digital content is delivered via direct website access, download, or email.
6) Granting Usage Rights for Digital Content
6.1 Unless otherwise stated, the customer receives a non-exclusive, unlimited right to use digital content for private purposes only.
6.2 Transfer or copying of digital content for third parties is not allowed unless approved by the seller.
6.3 Usage rights for one-time digital content delivery become effective after full payment. The seller can grant provisional usage before payment, but no transfer of rights occurs before payment.
7) Retention of Title

The seller retains ownership of delivered goods until full payment is received.
8) Liability for Defects (Warranty)

The statutory warranty provisions apply unless otherwise stated.

For business customers:

The seller can choose the type of remedy.
-
Warranty period for new goods is one year from delivery.
-
No warranty for used goods.
-
Warranty period does not restart after replacement delivery.

Exceptions to these limits include claims for damages, fraudulent concealment, defects affecting buildings, and obligations to update digital products.

For merchants (businesses), commercial inspection and complaint duties apply (§ 377 HGB).

Consumers should report visible transport damages to the carrier and inform the seller; failure to do so does not affect their warranty rights.
9) Einlösung von Aktionsgutscheinen
9.1 Aktionsgutscheine sind Gutscheine, die vom Verkäufer im Rahmen von Werbeaktionen mit einer begrenzten Gültigkeitsdauer unentgeltlich ausgegeben werden und vom Kunden nicht käuflich erworben werden können. Sie können ausschließlich im Online-Shop des Verkäufers und nur innerhalb des angegebenen Zeitraums eingelöst werden.
9.2 Einzelne Produkte können von der Gutscheinaktion ausgeschlossen sein, sofern dies aus dem Inhalt des Aktionsgutscheins hervorgeht.
9.3 Aktionsgutscheine müssen vor Abschluss des Bestellvorgangs eingelöst werden. Eine nachträgliche Verrechnung ist ausgeschlossen.
9.4 Pro Bestellung ist jeweils nur ein Aktionsgutschein einlösbar.
9.5 Der Warenwert muss mindestens dem Wert des Aktionsgutscheins entsprechen. Ein Restguthaben wird nicht erstattet.
9.6 Ist der Wert des Aktionsgutscheins nicht ausreichend, kann der Differenzbetrag mit anderen vom Verkäufer angebotenen Zahlungsarten beglichen werden.
9.7 Das Guthaben eines Aktionsgutscheins wird weder ausgezahlt noch verzinst.
9.8 Wird die Ware, die ganz oder teilweise mit einem Aktionsgutschein bezahlt wurde, im Rahmen des gesetzlichen Widerrufs zurückgegeben, erfolgt keine Erstattung des Gutscheins.
9.9 Der Aktionsgutschein ist übertragbar. Der Verkäufer erfüllt seine Leistungspflicht gegenüber dem jeweiligen Inhaber, der den Gutschein im Online-Shop einlöst, es sei denn, der Verkäufer hat Kenntnis von Unberechtigung, Geschäftsunfähigkeit oder fehlender Vertretungsbefugnis des Inhabers oder handelt grob fahrlässig.
10) Einlösung von Geschenkgutscheinen
10.1 Geschenkgutscheine sind käuflich erworbene Gutscheine, die im Online-Shop des Verkäufers eingelöst werden können, sofern nichts anderes angegeben ist.
10.2 Geschenkgutscheine und Restguthaben sind bis zum Ablauf des dritten Jahres nach dem Kaufjahr einlösbar. Das Restguthaben wird bis dahin gutgeschrieben.
10.3 Geschenkgutscheine müssen vor Abschluss des Bestellvorgangs eingelöst werden. Eine nachträgliche Verrechnung ist ausgeschlossen.
10.4 Pro Bestellung ist jeweils nur ein Geschenkgutschein einlösbar.
10.5 Geschenkgutscheine können ausschließlich für den Kauf von Waren und nicht für den Erwerb weiterer Gutscheine verwendet werden.
10.6 Ist der Wert des Geschenkgutscheins nicht ausreichend, kann der Differenzbetrag mit anderen vom Verkäufer angebotenen Zahlungsarten beglichen werden.
10.7 Das Guthaben eines Geschenkgutscheins wird weder ausgezahlt noch verzinst.
10.8 Der Geschenkgutschein ist übertragbar. Der Verkäufer erfüllt seine Leistungspflicht gegenüber dem jeweiligen Inhaber, der den Gutschein im Online-Shop einlöst, es sei denn, der Verkäufer hat Kenntnis von Unberechtigung, Geschäftsunfähigkeit oder fehlender Vertretungsbefugnis des Inhabers oder handelt grob fahrlässig.
11) Anwendbares Recht
11.1 Für sämtliche Rechtsbeziehungen zwischen den Parteien gilt deutsches Recht unter Ausschluss des internationalen Kaufrechts (CISG). Bei Verbrauchern gilt dies nur, soweit dadurch nicht der gesetzliche Schutz durch zwingende Vorschriften des Staates ihres gewöhnlichen Aufenthalts eingeschränkt wird.
11.2 Diese Rechtswahl gilt im Hinblick auf das gesetzliche Widerrufsrecht nicht für Verbraucher, die zum Zeitpunkt des Vertragsschlusses außerhalb der EU wohnhaft sind und deren Lieferadresse außerhalb der EU liegt.
12) Alternative Streitbeilegung
12.1 Die EU-Kommission stellt eine Plattform zur Online-Streitbeilegung bereit, erreichbar unter: https://ec.europa.eu/consumers/odr
Diese Plattform dient der außergerichtlichen Beilegung von Streitigkeiten aus Online-Kauf- oder Dienstleistungsverträgen mit Verbrauchern.
12.2 Der Verkäufer ist weder verpflichtet noch bereit, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
